TERMS AND CONDITIONS OF SALE

FARES AND RATES

All prices are expressed in U.S. Dollars and are subject to change without notice. Rates are guaranteed once payment is received.

RESERVATIONS

Reservations should be made as early as possible to assure confirmation of selected travel components. Reservations for travel components (air, hotels, car rentals, tours, rail, etc.) are subject to availability. Should circumstances beyond our control make changes necessary, we reserve the right to vary itineraries and/or inclusions or substitute hotels of similar standard.

DEPOSITS

For bookings made 61 or more days prior to departure, a deposit of $200 per person is due within 5 business days to activate the booking and avoid auto cancellation. Additional deposits may be required for certain products, and will be indicated on the initial quote. Payment of the deposit constitutes acceptance of the itinerary and deposits are non-refundable once paid.

FINAL PAYMENT

Full payment is due 60 days prior to departure, unless otherwise indicated. EuroVacations reserves the right to cancel a booking if full payment is not received on time. Bookings made less than 60 days prior to departure require full payment to activate the booking and payment constitutes acceptance of the itinerary and our terms and conditions. Visa, MasterCard, American Express, or Discover are all accepted forms of payment.

Reservations must be made at least 7 days prior to departure from the United States. A special handling fee of $25 will be assessed to bookings that require overnight express delivery. Overnight delivery requests will be accepted up until 5 p.m. Eastern Time, Monday through Friday. No Saturday or Sunday deliveries

Holiday Season Conditions: Special payment guidelines may be required for travel during the holiday season. This may result in additional charges or more restrictive cancel penalties, and are subject to change without notice.

HOTELS

Hotel rates found on this Website include (unless otherwise stated): accommodations with private bath or shower, Continental breakfast, hotel taxes, and general service charges. Local municipal city taxes may be additional in some cities / resorts and must be paid locally. Hotel rates do not include any expenses of a personal nature or any incidental charges. Room assignments are at the discretion of the hotel management and specific requests cannot be guaranteed. EuroVacations.com guarantees room types, which have appropriate bedding for the number of passengers requested per room. We do not guarantee a specific bed type.

TRANSFERS AND BAGGAGE

Porterage and baggage handling is not included with transfers unless specifically stated on the transfer voucher. Baggage allowance is limited, and varies by county and vehicle type. As a general rule, one medium-sized suitcase and one carry-on bag per person are allowed and the carry-on bag should fit on the passenger's lap. A larger vehicle must be booked in advance for large size bags and additional baggage. Failure to do this could result in additional charges to be paid locally, or cancellations of services altogether with no refund.

AIR CONDITIONING

Eurovacations is not responsible for air conditioning standards or availability, as these factors can vary greatly between properties and countries.

WHEELCHAIR ACCESSIBLE FACILITIES

Requests for accommodations to suit specific physical requirements, such as wheelchair accessible rooms, must be made at the time of booking and are subject to availability. Avanti Destinations cannot accept responsibility for the standards of such facilities requested, as they can vary between properties.

CHECK-IN

Check In cannot be guaranteed prior to 2 p.m. Departure is normally required by 11 a.m.

CAR RENTAL

Drivers must be at least 25 years of age; a maximum age may apply, subject to car rental company rules. Basic car rental rates include: unlimited mileage and VAT (value added tax). Rates do not include: tolls, gasoline, third driver surcharge, or overtime charges for car rental. Specific car models can not be guaranteed. Airport surcharges / one-way drop off fees may apply.

INSURANCE

Insurance covering baggage, trip cancellation or interruption, and personal accidents covering your reservation is strongly recommended. Limited travel protection insurance is available for purchase when you purchase your package. You must click "Yes" for "Travel Protection" on the Passenger Name Page in order to purchase this insurance. Although insurance is not required by EuroVacations.com to purchase any product, by not purchasing insurance you agree that you understand that EuroVacations.com has strongly recommended such coverage.

PASSPORT/VISA

EuroVacations.com is not responsible for the provision of passports or visas. Please check with the appropriate consulate for details.

AIR

Fares and schedules are based on regular scheduled service. All applicable airline rules apply. Schedules are subject to change. Basic air fares do not include: airport departure taxes, passenger facility charges (PFCs), customs and immigration fees, or excess baggage charges.

TRAVEL DOCUMENTS

Travel documents will be sent via 2-day UPS 24 hours after receipt of full payment. EuroVacations.com is not responsible for lost or stolen documents; therefore, any re-issuance of documents may be assessed their full face value.

AIR / LAND REVISIONS, CANCELLATIONS

Rules and fees for canceling and revising airfares vary depending upon the type of airfare purchased. Please see applicable rules when booking airfare. Revisions to land arrangements once booking is completed and paid for are subject to availability, and a revision fee of $25.00 per person per change will apply. No revisions are permitted within two weeks of departure. A $100-per-person fee, plus all non-refundable arrangements, will be assessed for all cancellations made after payment and more than 45-days prior to departure. For cancellations made within 45 days of departure, the following cancellation fees apply:

No refunds will be granted for lost/stolen documents. In addition, some "stand-alone" travel components that are cancelled and returned UNUSED within 6 months from the date of issue (rail tickets, rail passes, hotel vouchers, special cruises, etc.) have unique cancellation policies, which will be stated at time of booking and can range from 15% to 50% of the cost. Rail and air reservations are totally non-refundable.

REFUNDS

NO REFUND CLAIM WILL BE CONSIDERED OR PURSUED AND NO ACTION WILL BE TAKEN BY EuroVacations.com UNLESS NOTICE OF CLAIM IS RECEIVED WITH SUPPORTING DOCUMENTATION WITHIN 30 DAYS OF COMPLETION OF TRAVEL NO REFUNDS WILL BE GRANTED FOR UNUSED LAND ARRANGEMENTS ONCE THE TRIP HAS COMMENCED. ALL DOCUMENTS MUST BE RETURNED TO EuroVacations.com IN ORDER FOR A REFUND REQUEST TO BE CONSIDERED. IT IS STRONGLY RECOMMENDED THAT YOU USE CERTIFIED MAIL, SINCE MANY COMPONENTS MAY BE NON-REFUNDABLE IF LOST OR STOLEN. REFUND DECISIONS ARE DETERMINED BY EuroVacations.com PER THE SIGNED CONTRACT EXISTING BETWEEN EuroVacations.com AND THE SUPPLIER(S). NO REFUND DETERMINATION CAN BE MADE BY ANYONE OTHER THAN EuroVacations.com.

RESPONSIBILITY

Eurovacations.com and its directors, officers, employees, independent contractors, and agents act only as agents for the passenger in making arrangements for hotels, transportation, sightseeing, restaurants, or any other service described in this Web site. The individual tour participant and/or purchaser, by acceptance of the tour documents, agrees that Eurovacations.com and its directors, officers, employees, independent contractors, agents, or suppliers shall not be liable for any injury, damage, loss, accident, delay or irregularity, liability, or expense to person or property due to any act or default of any hotel, carrier, restaurant, company, or person providing or rendering any of the services included in the tours. The tickets, coupons, tariffs, rules, or contracts currently in use by any carrier, hotel, restaurant, or any other contractor providing service shall constitute the sole contract between such contractor and the tour participant. EuroVacations.com and its directors, officers, employees, independent contractors, agents, and suppliers accept no responsibility for any damage, delay or irregularity, expense, or liability arising from sickness, pilferage, labor dispute, machinery breakdown, quarantine, government restraints, war, act of terrorism, weather conditions, defect in any vehicle of transportation, or for any misadventure or causality or any other cause beyond their control. Any and all losses and expenses will be borne by the tour participant, the tour rates being only for the time period and places specified. All accommodations, services, and facilities are subject to the laws of the countries to which these accommodations, services, and facilities are provided. EuroVacations.com reserves the right to cancel or change itineraries and substitute services without notice and to decline to accept or retain any tour participant at any time.

USTOA $1 MILLION TRAVELERS ASSISTANCE PROGRAM

EuroVacations.com shares the coverage available under the USTOA $1 Million Travelers Assistance Program with affiliates of Rail Europe who, as an Active Member of the USTOA, is required to post $1 Million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA $1 Million Travelers Assistance Program, the advance payments of EuroVacations.com customers in the unlikely event of EuroVacations.com bankruptcy, insolvency or cessation of business. Further, you should understand that the $1 Million posted by Rail Europe and shared among its affiliates may be sufficient to provide only a partial recovery of the advance payments received by EuroVacations.com. COPYRIGHT DISPUTE RESOLUTION MECHANISM

Pursuant to the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2), copyright owners or their authorized agents may submit a complaint of alleged copyright infringement to EuroVacations.com, Inc. if they have a good-faith belief that their protected works are being infringed. EuroVacations.com will respond to all such notifications that are sent to:

To be effective, the notification must be a written communication that includes:

A physical or electronic signature of a person authorized to act on behalf of the owner of a right that is allegedly infringed;

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single website are covered by a single notification, a representative list of such works at that website;

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;

Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;

A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of such notification, EuroVacations.com shall promptly investigate the matter, and, if appropriate, remove or disable access to the allegedly infringing material. After EuroVacations.com removes or disables access to such material, EuroVacations.com will notify the party that posted the material of its action. Such party may then provide EuroVacations.com's designated agent proper "counter-notification" stating his, her or its authority to post the allegedly infringing material, which EuroVacations.com will forward to the alleged copyright owner. EuroVacations.com will inform the alleged copyright owner that EuroVacations.com will repost the removed material or cease disabling access to it in ten to fourteen business days unless the alleged copyright owner sends a second notification to EuroVacations.com's designated agent stating that it has filed suit against the alleged infringer.

An effective counter-notification must be sent to EuroVacations.com's designated agent, whose name and address are listed above. The notice must include the following information:

The counter-notifying party's physical or electronic signature;

Identification of the material that has been removed or disabled and the location where the material was before its removal or disablement;

A statement, under penalty of perjury, that the party has a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and

The counter-notifying party's name, address, phone number, and a statement that the party consents to the jurisdiction of the federal court in its district, or if the subscriber is foreign, it consents to any jurisdiction where EuroVacations.com is subject to jurisdiction, and that the subscriber will accept service of process from the person who provided EuroVacations.com with notification or an agent of such a person.

Before entering into arbitration, the parties shall each appoint an arbitrator, and these two arbitrators shall select a third arbitrator to be a member of the panel. Should the two arbitrators not be able to agree on a choice of the third, then the American Arbitration Association shall make the appointment of a person who is neutral to the parties. None of the arbitrators shall be officers or employees of the parties to these Terms of Service. Such arbitrators shall be experts in the computer/information technology field. The cost of arbitration, including fees per arbitrator, shall be borne equally by the parties. The location of arbitration shall be Portland, Oregon, USA.
